PropFlo Inc.
(“PropFlo,” “we,” “our,” or “us”), you (“the User” or “the Landlord”) agree to be bound by these Terms and Conditions. These terms apply to all services provided by PropFlo, including our
self-serve landlord platform
,
virtual assistant services
, and
handyman services
.
Important Note:
PropFlo is
not a licensed property management company
or
real estate brokerage
and does not engage in regulated property management activities as defined by the
Real Estate Council of Alberta (RECA)
.
2.1 PropFlo Software Platform
The PropFlo platform provides landlords with access to
self-serve tools and automation features
to assist in managing their own properties. These tools include, but are not limited to:
Tenant communication tools (AI-driven chatbots, SMS, and email integration).Property management dashboards for organizing leases and maintenance requests.Automated reminders and reporting tools.
2.2 Virtual Assistant (VA) Services
PropFlo offers
virtual assistant services
to help landlords manage administrative tasks related to the
PropFlo platform
.
Permitted VA Activities Include:Assisting with software setup and configuration.Providing customer support related to the PropFlo platform.Data entry and organization of property-related information.Coordinating task reminders and schedules.Prohibited VA Activities (Not Permitted):Negotiating leases or discussing lease terms.Providing legal advice or representing the landlord in any capacity.Collecting rent or security deposits.Making decisions regarding tenant approvals or disputes.
2.3 Handyman Services
PropFlo offers access to
handyman services
to assist landlords with property-related tasks such as repairs, inspections, and property access. These services are for
physical tasks only
and are
NOT related to property management activities
.
Permitted Handyman Activities:Performing general repairs and maintenance.Documenting property conditions (e.g., taking photos or filling out condition reports).Providing supervised access for property showings or move-in/out inspections.Prohibited Handyman Activities:Negotiating with tenants or representing the landlord.Approving tenant requests or resolving tenant disputes.Acting as the landlord’s representative in any formal capacity.
PropFlo operates as a
technology and staffing solution provider
. We do
not
perform activities that are regulated by the
Real Estate Council of Alberta (RECA)
, including but not limited to:
Negotiating lease terms on behalf of landlords.Providing legal or financial advice.Collecting rent, security deposits, or any other tenant funds.Advertising properties on behalf of landlords outside of a self-serve model.
Landlord Responsibility:
The Landlord retains full control and decision-making authority over their properties.The Landlord is responsible for ensuring compliance with all real estate and tenancy laws in their jurisdiction.
The Landlord agrees to
indemnify, defend, and hold harmless PropFlo, its officers, directors, employees, and agents
from any claims, damages, liabilities, or expenses (including legal fees) arising from:
The Landlord’s misuse of PropFlo’s services.Non-compliance with applicable laws and regulations.Actions or decisions taken by the Landlord or their virtual assistant/handyman that result in legal disputes.
PropFlo shall not be held liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services.PropFlo does not guarantee the outcomes or effectiveness of any services provided.Handyman and Virtual Assistant services are provided as-is, and PropFlo does not assume responsibility for any disputes or claims arising from their activities.
PropFlo reserves the right to:
Modify, suspend, or discontinue any service at any time, with or without notice.Update these Terms and Conditions periodically. Continued use of the services constitutes acceptance of any changes.
All fees for services, including hourly VA services, handyman services, and software subscriptions, are billed according to the agreed-upon rate.PropFlo will provide detailed invoices, including hours worked and applicable staffing fees for VA services.Payments must be made within the specified timeframe on the invoice.
This Agreement begins on the date of acceptance and continues until terminated by either party with 14 days’ written notice.PropFlo may terminate the Agreement immediately for non-compliance with these Terms.
This Agreement shall be governed by and interpreted in accordance with the laws of the
Province of Alberta
, without regard to its conflict of law principles.
These Terms and Conditions constitute the entire agreement between the parties and supersede any prior agreements or understandings, whether written or oral.
